01About these terms
These Terms of Service ("Terms") govern your use of Handle, including the Handle apps, the Handle website builder, the AI agent and every related service (together, the "Service"). The Service is operated by 44pixels Limited ("44pixels", "we", "us" or "our"), a company registered in England and Wales, with its registered address at 99 Milton Keynes Business Centre, Foxhunter Drive, Linford Wood, Milton Keynes, MK14 6GD, United Kingdom.
By creating an account, joining a trial or using the Service, you agree to these Terms. If you are accepting them for a business, you confirm that you have authority to bind that business, and "you" means the business. If you do not agree, do not use the Service.
Handle is built for businesses. You confirm that you are using the Service for your trade, business or profession and not as a consumer.
02What Handle does
Handle is an AI agent for service businesses. Depending on your plan and what you turn on, Handle can:
- answer your business calls, and reply to texts, social media messages, website chat and email,
- ask callers and customers the questions you choose, and write up what they need,
- book, move and cancel appointments on your calendar,
- send quotes, invoices, reminders, follow ups and review requests to your customers,
- build, host and update a website and business profiles for your business,
- research things for you, such as local competitors or routes between jobs, and
- carry out other tasks you ask for in the app.
We are improving Handle all the time, so features will change. Some features are labelled early access or beta (see section 17).
03Your account
You must be at least 18, and able to enter into a binding contract, to use the Service. You must give us accurate information when you sign up and keep it up to date. You are responsible for everything that happens under your account, including the actions of team members you invite, and for keeping your login details secure. Tell us straight away at support@handle.inc if you think someone has accessed your account without permission.
04Handle acts on your behalf
You are in control. Handle takes actions for your business based on the information, instructions and settings you give it ("Your Instructions"). You decide which channels Handle covers, what Handle may say, and which actions Handle may take on its own and which need your approval first.
You are responsible for those actions. Messages Handle sends, bookings Handle makes, and quotes, invoices and other actions Handle takes within the permissions you have set are made on your behalf, as your business. To customers and other people, they come from you, not from 44pixels. You are responsible for them as if you had taken them yourself.
Limits on what Handle agrees to. Unless you set Handle up to do so, Handle will not agree contracts, give binding prices, make guarantees, approve refunds or change your terms with customers. If you allow any of these, you accept them as your own commitments.
Review and oversight. You are responsible for reviewing Handle's settings before you switch features on, checking Handle's work regularly, and dealing with anything Handle cannot deal with. Handle may ask you to confirm an action before taking it, and you are responsible for the actions you approve.
05AI output
Handle uses artificial intelligence. Its answers, transcripts, summaries, quotes, research, website text and other output ("Output") may be inaccurate, incomplete, out of date or unsuitable for your situation. Output can look confident and still be wrong.
- Check important Output before you rely on it or send it to anyone.
- Output is not professional advice of any kind, including legal, financial, tax, medical or safety advice.
- Do not use Output to make decisions that have a legal or similarly significant effect on a person without human review.
Output produced from your content may be similar to output produced for other users. You may use Output for your business, subject to these Terms.
06Not for emergencies
Handle is not an emergency service, and no phone number we provide can be used to reach emergency services (such as 911, 999 or 112). Do not publish any phone number we provide as an emergency contact, and keep another way to reach emergency services and to deal with urgent jobs.
We do not guarantee that every call or message will be answered, delivered, recorded, transcribed or acted on, or that Handle will respond within any particular time. Keep your own process for anything time critical.
07Calls, texts and messages
Consent to contact people
When Handle calls, texts or emails people for you, including follow ups, reminders, review requests and messages to past customers, you are the sender. You confirm that you have every consent the law requires to contact each person in the way Handle contacts them, including any prior express written consent needed for calls or texts made with an AI or artificial voice. You must honour opt outs and keep any records the law requires. The rules include, where they apply, the US Telephone Consumer Protection Act, state telemarketing laws and carrier messaging rules, the UK Privacy and Electronic Communications Regulations, Canada's Anti-Spam Legislation, and equivalent laws elsewhere.
Handle processes opt out replies such as STOP, but you remain responsible for respecting opt outs that reach you another way.
Recording, transcription and AI disclosure
Handle records and transcribes calls and keeps message history so Handle can do its job and show you what happened. By default, Handle tells callers that the call is answered by an AI agent and may be recorded. You are responsible for making sure your greetings and settings give every notice, and obtain every consent, that recording and AI laws require where you and your callers are, including in places where all parties must consent to a recording. If you change or remove a default notice, you take responsibility for that choice.
Phone numbers
We may provide you with a phone number for use with Handle (a "Handle Number"), through third party telephony providers. A Handle Number is licensed to you while your subscription is active. You do not own it. If your subscription ends, we may hold the number for a short grace period and then release it, and it may be given to someone else. Update anywhere you have published the number before then. We may need to change a Handle Number where a provider, carrier or regulator requires it, and will give you notice where we can.
Some messaging, particularly in the US, requires your business to be registered with carriers. You authorize us to submit your business details for that purpose, and some messaging may be limited until registration is complete.
Call forwarding and caller ID
If you forward your existing number to Handle, you set up forwarding yourself, on your phone or with your carrier, and you can turn it off at any time the same way. We cannot change your phone or carrier settings. Cancelling Handle does not switch forwarding off, so remember to do it yourself. Carrier charges for forwarding are your responsibility.
If you have Handle show your own number as the caller ID on calls or texts it makes, you confirm that you own the number or are authorized to use it, and that you will use it lawfully and never to mislead anyone about who is calling.
Calls and messages travel over third party networks. We do not control and are not responsible for carrier outages, blocking, filtering or spam labelling.
08Connected accounts
You can connect Handle to other services you use, such as your calendar, email, social media accounts, Google Business Profile, accounting software and payment provider ("Connected Accounts"). When you connect one, you authorize us to access, store and act on information in it, and to take actions in it, to the extent needed to provide the features you have turned on. You confirm that you are allowed to connect the account.
Your use of a Connected Account is also governed by that service's own terms. We are not responsible for third party services, and features that depend on them may stop working if the service changes or you disconnect it. You can disconnect a Connected Account at any time in Handle or in the other service's settings.
09Your website
Handle can build and host a website for your business, on your own domain or on an address we provide.
- It is your website. You own the content of your website (your text, photos, logo and business information, and the Output generated for it). You can download that content while your subscription is active and for 30 days after it ends, after which section 11 applies.
- Our platform stays ours. The templates, code, design system and hosting that run the website belong to us. You may use them while your subscription is active.
- Your domain stays yours. If you connect a domain you own, it stays registered to you. If we register a domain for you, we will help you transfer it to your own registrar on request, subject to the registrar's rules and any fees.
- Public means public. A published website, business profile or review reply can be seen, indexed by search engines, summarized by AI assistants, copied and archived by others. Unpublishing removes it from our servers but cannot recall copies others have made.
- You are responsible for what it says. You confirm that you have the rights to everything on your website and that it is accurate and lawful, including your prices, reviews, licences and claims about your work. We may unpublish content that we reasonably believe breaks these Terms or the law.
We do not guarantee any search ranking, number of leads or level of business.
10Payments you take through Handle
If you send invoices or take payments through Handle, the payments are processed by a third party payment provider, under an account you hold with that provider and its terms. 44pixels is not a bank or payment processor and does not hold your customers' money. You are responsible for your prices, taxes, refunds and disputes with your customers.
11Your data
Your Content. "Your Content" means the information you and your customers give the Service, including your business information and instructions, call recordings, transcripts, messages, contacts, calendar entries, files and photos. As between you and us, you own Your Content.
Our permission to use it. You give us a worldwide, non-exclusive, royalty free licence to host, copy, process, transmit, display and adapt Your Content only as needed to provide, secure, support and improve the Service for you, and to comply with the law. This licence ends when Your Content is deleted from the Service, except for copies we must keep by law.
No AI training on your data. We do not use Your Content to train AI models, and our agreements with the AI providers we use do not allow them to train their models on it. We may use aggregated, de-identified information that cannot be linked to you or any person to measure and improve how Handle performs.
Your customers' personal data. For personal data about your customers, callers and contacts that we process for you, you are the controller and we act as your processor (or service provider). We process it under your instructions, as described in our Privacy Policy. You confirm that you have the right to give us this data and that you have told people how it will be used, as the law requires. We will provide a data processing agreement on request.
Sensitive data. Do not set Handle up to collect payment card numbers, government ID numbers, passwords, health information or other sensitive data unless the feature is designed for it.
Deleting data. You can delete your account and Your Content at any time. Otherwise, we delete Your Content within 90 days after you close your account or your subscription ends, whichever comes first, except where we must keep it by law or to resolve disputes. Backups are overwritten in the normal course. Our Privacy Policy sets out how long we keep other information.
12Acceptable use
You must not use Handle, or let anyone use Handle, to:
- break the law or anyone else's rights,
- send spam or unsolicited, deceptive or harassing calls and messages,
- impersonate another person or business, or mislead people about who they are dealing with,
- run scams or fraud, or collect information under false pretences,
- create or share sexual, hateful, violent or otherwise abusive content, or run adult or premium rate lines,
- publish fake reviews, or reviews you are not entitled to post,
- handle calls or messages you have no right to receive,
- probe, overload, disrupt or gain unauthorized access to the Service,
- copy, reverse engineer or resell the Service, except where the law allows, or
- build a competing product, or extract data or models from the Service.
We may apply fair usage limits, such as minutes, messages or tasks, to protect the Service. Your plan sets out any limits that apply. We may suspend or restrict your account, immediately and without notice where reasonable, if we believe you are breaking these Terms or the law, if your use creates a security, fraud, legal or telecoms risk, or if a carrier, regulator or provider requires it. Where we can, we will tell you why and give you a chance to fix the problem.
13Subscriptions and payment
Plans. Prices and what each plan includes are shown when you subscribe. Prices exclude taxes unless stated.
Renewal. Subscriptions renew automatically at the end of each billing period, monthly or yearly, until you cancel. By subscribing, you authorize us (or the app store you subscribe through) to charge your payment method for each renewal.
Trials. If you start a free trial, it turns into a paid subscription at the end of the trial unless you cancel before then.
Cancelling. You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Refunds. Fees are not refundable for partly used periods, except where the law requires otherwise. Purchases made through the Apple App Store or Google Play are handled by that store under its own refund rules.
Price changes. We will give you at least 30 days' notice of a price change, which applies from your next billing period. If you do not agree, cancel before the change takes effect.
Failed payments. If a payment fails, we may limit or suspend the Service until it is paid.
14Communications from us
We will send you messages about your account and the Service, such as receipts, security alerts and changes to these Terms. With your permission, or where the law otherwise allows, we may also send you product news and offers. You can unsubscribe from marketing at any time using the link in those messages.
15Our intellectual property
The Service, including its software, AI agent, designs, templates and the Handle name and logo, belongs to 44pixels and its licensors. While your subscription is active, we grant you a limited, non-exclusive, non-transferable right to use the Service for your business, under these Terms. If you send us feedback or ideas, we may use them without owing you anything.
16Third party services
Handle relies on third party providers for things like telephony, messaging, AI, hosting and payments. Your use of features that depend on them may also be subject to their terms. We choose our providers carefully, but we are not responsible for services we do not control.
17Early access and beta features
Features labelled early access, beta or preview are still being tested. They may change, stop working or be withdrawn without notice, and they are provided as they are, without any commitment about how they will perform.
18Changes to the Service
We may change, add or remove features, AI models and providers. If we remove a feature that is a material part of what you pay for, we will tell you in advance where we can, and you may cancel.
19Warranties
We will provide the Service with reasonable care and skill. Apart from that, and to the extent the law allows, the Service is provided "as is" and "as available", and we make no other promises, including that the Service will be uninterrupted, error free or suitable for your particular needs, that data will never be lost, or that Output will be accurate.
20Limitation of liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Subject to that, and to the extent the law allows:
- we are not liable for loss of profits, revenue, business, bookings, goodwill or data, or for any indirect or consequential loss,
- we are not liable for missed or mishandled calls or messages, for actions Handle takes within the permissions you have set or the actions you approve, or for claims arising from your failure to obtain consent or follow the law, and
- our total liability to you for all claims relating to the Service is limited to the greater of the fees you paid us in the 12 months before the event giving rise to the claim and £100.
21Indemnity
You will defend and compensate 44pixels against claims by third parties, and related losses and reasonable costs, arising from Your Content, Your Instructions, actions taken on your behalf within the permissions you set, your communications with your customers, or your breach of these Terms or the law.
22Ending these Terms
You can stop using the Service and close your account at any time. We may end these Terms or close your account by giving you 30 days' notice, or immediately if you seriously or repeatedly break these Terms, if you fail to pay, or if the law or a provider requires it. When these Terms end, your right to use the Service stops, and we will handle Your Content as section 11 describes. Sections that by their nature should continue, such as payment owed, liability and indemnity, will continue.
23Changes to these Terms
We may update these Terms. If a change is material, we will give you at least 30 days' notice by email or in the app before it takes effect. If you do not agree to the change, you can cancel before then. If you keep using the Service after the change takes effect, the updated Terms apply.
24General
- Governing law. These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
- Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
- Transfer. You may not transfer these Terms without our written consent. We may transfer them to a successor in a merger, acquisition or sale of assets.
- Whole agreement. These Terms, the Privacy Policy and any order or data processing agreement you sign with us are the whole agreement between us about the Service.
- Severability. If part of these Terms cannot be enforced, the rest still applies.
- No waiver. If we do not enforce a right straight away, we can still enforce it later.
